Terms of Service

These Terms of Service ("Terms") govern your use of the Nest Pest Control website and our pest control services. By using our site, booking a service, or creating an account, you agree to these Terms. If you do not agree, please do not use our services.
1. Definitions
- Customer means the person or entity ordering services from Nest Pest Control.
- Service Provider means Nest Pest Control and its employees, technicians, and authorized representatives.
- Treated Area means the property, building, room, or outdoor space where treatment is applied. If an area cannot be fully separated (for example, by a closed door), the Treated Area also includes any space directly connected to it.
2. The Pest Control Service
Services are performed in accordance with applicable federal, state, and local laws, either as a one-time treatment or as part of a recurring plan agreed between the Customer and the Service Provider. All work is performed under a North Carolina–certified pesticide applicator using EPA-registered products applied per label directions. Our technicians will select and apply products and devices they determine to be appropriate for the conditions found at each visit.
3. Customer Obligations
By booking a service, you confirm that you are at least 18 years old and legally able to enter into a binding agreement. You agree to:
- Provide accurate contact, address, and property information at the time of booking.
- Provide safe and timely access to the Treated Area for our technicians at the scheduled appointment time.
- Follow the recommendations of the Service Provider within a reasonable period to help reduce pest activity (for example, sealing entry points, addressing moisture, or removing harborage).
- Pay for services promptly in accordance with the agreed terms.
- Maintain any monitoring stations, traps, or devices we install on the property. Damage beyond normal wear and tear may result in a replacement charge.
- Disclose in advance any known allergies, medical sensitivities, or the presence of pets, livestock, beehives, or aquariums on the property.
4. Pre- and Post-Treatment Preparation
To keep your household safe and to allow products to work properly, please follow these guidelines unless your technician gives you different instructions in writing:
- Cover or remove all food, drinks, and pet food from the Treated Area before treatment, and keep them away for at least four (4) hours after treatment.
- Keep children, pets, and other animals out of the Treated Area during treatment and for at least four (4) hours afterward. If small children, toddlers, or animals may crawl or walk on treated floors after that 4-hour window, the floors should be washed first to avoid contact exposure. In other cases, mop or wash treated floors no sooner than three (3) days after treatment so the product has time to work.
- Keep cribs, playpens, and pet bedding away from treated baseboards and surfaces.
- Cover or remove fish tanks and turn off aquarium air pumps during interior treatments; your technician will advise on timing.
5. Pricing & Payment
- Prices for each service or plan are shown at checkout. All prices are in U.S. dollars and exclude applicable taxes unless stated otherwise.
- Payment is due at the time of service for one-time treatments, and on the billing cadence shown at sign-up for recurring plans (quarterly or annually). Yearly plans receive a 10% discount versus the equivalent quarterly rate.
- Payments are processed securely by Stripe. By submitting payment, you authorize us to charge your payment method for the agreed amount.
- Quoted prices may vary based on square footage, severity, accessibility, and other on-site factors. We reserve the right to adjust pricing for additional services, treatments, or visits requested by you that were not part of the original booking. Any change will be communicated and agreed before additional work is performed.
- Prices for future services may change from time to time. Changes will not affect services already confirmed in writing or already paid for.
- We may recover reasonable costs incurred in collecting overdue amounts. Customers may not withhold payment for completed services.
6. Changes & Cancellations
You may reschedule or cancel a scheduled appointment at any time, but the following fees may apply to cover our costs and the time reserved for your job:
- More than 24 hours' notice: no charge.
- Less than 24 hours' notice: 50% of the price of the treatment (including tax), whether or not you have already paid.
- After our technician arrives on site but before work begins: 75% of the price of the treatment.
- After work has begun: the full price of the treatment.
For recurring plans, you may cancel at any time from your account or by contacting us. Cancellation takes effect at the end of the current paid billing cycle, and we do not prorate partial periods unless required by law.
We will make reasonable efforts to keep every appointment, but in rare cases we may need to reschedule (for example, technician illness, vehicle issues, severe weather, or a previous job running long). When that happens, we will contact you on the number you provided to arrange a new time. If we fail to show up and fail to contact you before the end of your appointment window, you may choose to either reschedule with a 10% discount on that visit, or cancel and receive a full refund of any prepaid fees for that visit.
We reserve the right to stop or refuse a treatment if continuing would not be safe, if conditions on site differ materially from what was disclosed, or if pesticides or monitoring devices have been tampered with. In such cases no refund will be provided for work already performed or for the reserved appointment time.
7. Re-Treatment Coverage
For active recurring plans, we provide re-treatment between scheduled visits for covered pests at no extra charge, subject to plan details. Re-treatment coverage does not apply to pests outside the scope of your plan, structural issues, or conditions conducive to infestation that have not been corrected after we have recommended action.
8. Warranty
We warrant that our services will be performed with reasonable care and skill, that the products we use meet applicable regulatory requirements, and that our work aims to control the pests covered by your service plan, subject to safety and access factors beyond our control. No other warranties, express or implied, are provided unless stated in writing in your service plan.
9. Disclaimers
Pest control results depend on factors outside our control, including environmental conditions, structural issues, neighboring properties, and customer cooperation. Our website and services are provided "as is" and "as available" to the maximum extent permitted by law. We disclaim all implied warranties not expressly stated in these Terms or your service plan.
10. Limitation of Liability
To the maximum extent permitted by law, Nest Pest Control's total liability for any claim arising from your use of our services is limited to the amount you paid us for the service giving rise to the claim in the 12 months prior. We are not liable for indirect, incidental, special, or consequential damages, including loss of use, loss of business, or damage to property unrelated to our direct work. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Account Use
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating an account, to keep that information up to date, and not to share your password or let any other person use your account. Notify us immediately if you believe your password has been compromised or your account has been used without your permission. We may suspend or terminate accounts at any time, including where we reasonably believe an account is being used in a way that violates these Terms or could disrupt our services.
12. Acceptable Use
You agree not to misuse our website or services, including by uploading unlawful content, attempting to gain unauthorized access, interfering with operation, or using the site to harass others. We may suspend or terminate accounts that violate these Terms.
13. Communications & SMS Consent
By providing your phone number through our website, booking form, or account, you agree that we may contact you at that number — including by automated calls or text messages — for service-related purposes such as appointment confirmations, reminders, technician arrival updates, billing notices, and follow-ups. Standard message and data rates may apply.
We may also send you marketing or promotional calls and text messages at the number you provide. Your consent to receive marketing communications is not a condition of purchasing any service. You can opt out of marketing texts at any time by replying STOP to any message, opt out of marketing emails using the unsubscribe link, or contact us through our contact page. You may continue to receive transactional, service-related messages even after opting out of marketing.
14. Intellectual Property
All website content, logos, trademarks, graphics, layouts, copy, and software are owned by Nest Pest Control or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by us, you may not copy, reproduce, modify, distribute, publicly display, sell, or create derivative works from any part of our website or services. You may not use automated tools to systematically retrieve or scrape information from our site.
Photos you upload (for example, through "Snap a Pest") remain yours. By uploading them, you grant us a non-exclusive, royalty-free license to use them to identify pests, deliver your service, document our work, and improve our services. We will not publicly publish identifiable photos of your property for marketing purposes without your permission. We may remove uploaded content at any time at our discretion.
15. Website "As Is" & Third-Party Links
Our website is provided on an "as is" and "as available" basis. We do our best to keep information accurate and the site available, but we do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses, or that any information on the site is complete or up to date. The most accurate information about your specific service will come from your technician or written service agreement.
Our site may contain links to third-party websites or services (for example, our payment processor, email provider, or social media pages). We do not control these third parties and are not responsible for their content, privacy practices, or terms. Your use of any third-party site is governed by that site's own terms and privacy policy.
16. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
17. Waiver & Severability
If we do not enforce a right or provision under these Terms on any occasion, that does not waive our right to enforce it later. If any part of these Terms is found unenforceable, the remaining provisions stay in full effect.
18. Changes to These Terms
We may revise these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. The version in effect at the time you book a service applies to that service. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
19. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in North Carolina.
